Please read this notice carefully before installing or operating your TimeMoto device.

This notice applies to the TimeMoto TM-424, which supports fingerprint verification. The TimeMoto TM-414 does not use biometric identification.

The TimeMoto TM-424 (the "Device") may optionally be used to collect Biometric Information from individuals, including your employees, workforce or other individuals.

"Biometric Information" is any information, regardless of how it is captured, converted, stored or shared, based on an individual's biometric identifier used to identify an individual, including (but not limited to) a fingerprint.

The use of biometric information is entirely optional and at the discretion of the Customer, other methods of user authentication are available with the Device. Biometric Information generated by the optional fingerprint verification function is stored locally on the Device and is not transferred to TimeMoto. TimeMoto does not receive, host, access, or control that locally stored Biometric Information. By installing and operating the biometric functions of the Device, you certify that you are solely responsible for adhering to all laws or regulations relating to the collection of Biometric Information from any individual, including providing any required notices, obtaining any required consent, permission, or other authorization, establishing any required lawful basis, maintaining any required biometric policy or retention schedule, and deleting Biometric Information when no longer needed.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Workwell Technologies, TimeMoto B.V., and their affiliates from third-party claims, losses, damages, costs, and reasonable attorneys’ fees arising from Customer’s enablement or use of the biometric functions of the Device, including Customer’s failure to comply with laws applicable to Customer’s collection, use, retention, deletion, or other handling of Biometric Information. This indemnity does not apply to the extent a claim is caused by Workwell’s or TimeMoto’s inaccurate product documentation, unauthorized access to or processing of Biometric Information, security failure, or failure of the Device to operate as documented. Claim procedures are governed by the applicable written terms between the parties.You agree to promptly notify Workwell in writing of any indemnifiable claim and give Workwell the opportunity to defend or negotiate a settlement of any such claim.
